Agreement
These Terms of Service ("Terms") govern your use of the Circa mobile application and related services ("Circa") operated by Cyrene LLC ("we," "us," or "our"). By creating an account or using Circa, you agree to these Terms.
If you do not agree, do not use Circa.
CIRCA IS NOT A BACKUP. Photos and videos stay on Circa's servers for about 30 days so members can download them. The lasting copy lives on members' phones. Circa is not a substitute for your camera roll, iCloud Photos, Google Photos, or any other backup. If you lose your phone without Circa's optional iCloud Drive backup (Settings → Storage), your copy of those photos can go with it.
Where Circa Is Available
Circa is offered in the United States, Canada, Australia, and New Zealand. By using Circa you represent that you are located in one of those countries (or are using Circa while temporarily abroad from one of them). We may refuse, suspend, or limit access from other territories.
What Circa Is
Circa is a shared-memory app for families, friend groups, crews, and teams. Circa is not a cloud backup service, a public social network, or a storage plan.
You post photos and videos into Group memories and Group chat. They stay on Circa's servers for about 30 days; the lasting copy is on members' phones.
Accounts
You must provide accurate information and keep your account secure. You are responsible for activity under your account.
You must be at least 13 years old to use Circa. We ask for your date of birth to check.
One person may not maintain more than one account for abusive purposes.
Devices and Software
You must provide your own device, software, and data connection to use Circa. Circa does not supply those.
To keep Circa working and secure, you consent to download and install updates when we make them available, including updates that Circa may require before you can continue using the service. We may refuse access from builds that are below a minimum version we publish.
You also consent to Circa sending you notifications as needed to provide the service, when you have enabled notifications.
You are responsible for carrier data plans, Internet fees, and other fees and taxes associated with your use of Circa.
Groups and Membership
Groups are persistent containers for shared memories. Group founders and admins may manage membership, settings, and moderation within their Group.
Leaving a Group or being removed may limit your access to that Group's content. Group content belongs to the Group context, not to any individual member's personal archive unless you separately save or export it.
Your Content
You retain ownership of content you upload. By posting in Circa, you grant Cyrene LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, transmit, and otherwise use your content solely to operate and provide Circa to you and your Group members — including storing media on our servers for about 30 days as we deliver it to members' devices.
The rights you grant in this license are limited to operating Circa. We do not claim ownership of your photos, videos, captions, or messages.
You represent that you have the right to share the content you upload and that it does not violate these Terms or applicable law.
You may not upload content that is illegal, harassing, exploitative, infringing, or otherwise harmful. We may remove content and suspend accounts that violate these rules.
Acceptable Use
You agree not to:
- Use Circa as a bulk photo backup or automated upload tool
- Scrape, reverse engineer, or disrupt Circa
- Impersonate others or misrepresent your affiliation
- Upload malware or attempt unauthorized access to our systems
- Harass, threaten, or abuse other users
- Post objectionable content, including content that is illegal, hateful, threatening, abusive, harassing, defamatory, sexually explicit, or that infringes someone else's rights
- Misuse reporting channels, including by submitting fraudulent or groundless reports
Circa+ is intended for personal social memory use. We reserve the right to limit accounts that use the service in ways inconsistent with that intent, including bulk imports, automated uploads, or commercial use without permission.
Content Moderation and Reporting
Circa has no tolerance for objectionable content or abusive members. You can report a post or chat message from within the app, or by emailing support@usecirca.app. We review reports sent to Circa and aim to act on objectionable content within 24 hours by hiding or removing the content and, when appropriate, suspending the responsible account. You can leave a Group at any time. Group founders and admins can remove members. Circa may suspend or terminate accounts that violate these Terms.
Advertising
Free Circa shows ads on Today and Memory Lane (Feed, Grid, and Theater), served by Google AdMob. Ads do not appear in Group chat or Camera. Circa+ removes ads. See the Privacy Policy for how advertising works.
Subscriptions and Plans
Circa is free with ads on Today and Memory Lane, or Circa+ to remove those ads. Circa+ is a personal Apple In-App Purchase. One purchase is one person; it does not cover a Group.
Payment is charged to your Apple ID. Subscriptions renew automatically unless canceled at least 24 hours before the period ends. Manage or cancel in Settings → Apple ID → Subscriptions. Refunds follow Apple App Store policy.
Retention
Photos and videos leave Circa's servers after about 30 days and live on members' phones. Circa is not your backup. A new member does not receive older photos from Circa. If you lose your phone without Circa's iCloud backup, your archive can go with it.
Deleting your account removes your profile and your messages. Photos you posted in a Group may remain, shown as from a Former member. See the Privacy Policy for backups, legal holds, and sub-processors.
Third-Party Services
Circa may let you use or interact with third-party products and services. For example, you may turn on Circa's optional backup to Apple iCloud Drive in Settings → Storage. These Terms and our Privacy Policy apply only to Circa. When you use iCloud, Apple Photos, Sign in with Apple, Google Sign-In, AdMob, or any other third-party product, that party's terms and privacy policy govern that product.
We are not responsible for third-party services, including loss of a backup stored in iCloud.
Apple App Store Terms
If you downloaded Circa from the Apple App Store, the following terms also apply:
- These Terms are between you and Cyrene LLC, not Apple. Apple is not responsible for Circa or its content.
- The license granted to you for Circa is limited to a non-transferable license to use Circa on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms.
- Cyrene LLC, not Apple, is solely responsible for providing any maintenance and support for Circa. Apple has no obligation to furnish any maintenance or support.
- Cyrene LLC, not Apple, is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Circa fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for Circa; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Cyrene LLC, not Apple, is responsible for addressing any claims by you or a third party relating to Circa or your possession and use of Circa, including product-liability claims, any claim that Circa fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar legislation.
- In the event of a third-party claim that Circa or your possession and use of Circa infringes that party's intellectual property rights, Cyrene LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and contact for notices: Cyrene LLC. Email support@usecirca.app. Cyrene LLC's mailing address is the address on file with Apple App Store Connect for the Circa developer account and with the U.S. Copyright Office DMCA Designated Agent Directory.
- You must comply with applicable third-party terms when using Circa (for example, your wireless data-service agreement).
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Copyright and DMCA
If you believe content on Circa infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent:

Include: your contact information; a description of the copyrighted work; the location of the allegedly infringing material in Circa; a statement that you have a good-faith belief the use is not authorized; a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act; and your physical or electronic signature.
We may remove or disable access to material claimed to be infringing and, in appropriate circumstances, terminate accounts of repeat infringers. Counter-notices may be sent to the same agent address.
Termination
You may stop using Circa at any time. You may delete your account in Settings → Delete Account, or contact support@usecirca.app from your account email for help.
We may suspend or terminate accounts that violate these Terms or pose risk to other users or our infrastructure.
Upon termination, your right to use Circa ends. Provisions that should survive (including Your Content, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Disputes, Apple App Store Terms, and Other) will survive.
Availability of Circa
We are always trying to improve Circa. That means we may expand, add, change, or remove features, including retiring surfaces that no longer fit the product. Circa may be interrupted for maintenance, repairs, upgrades, or failures beyond our control.
We may modify, suspend, or terminate your access to Circa at any time for any reason, including if you violate these Terms or create harm or legal risk for us, our users, or others.
Disclaimers
Circa is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free service. We do not control how other members use Circa or what they post. You use Circa at your own risk.
Limitation of Liability
To the maximum extent permitted by law, Cyrene LLC and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill.
Our total liability for any claim arising from these Terms or your use of Circa will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars (US $50) if you paid nothing.
Indemnification
To the maximum extent permitted by law, you will indemnify and hold harmless Cyrene LLC and its directors, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your access to or use of Circa; (b) your content; (c) your breach of these Terms or applicable law; or (d) any misrepresentation you make.
Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or to Circa are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
You and Cyrene LLC agree that the state and federal courts located in Texas have exclusive jurisdiction over any dispute that is not resolved informally, and you consent to personal jurisdiction in those courts.
You and we agree that any claim must be filed within one (1) year after the claim first arose, or it is permanently barred, to the fullest extent permitted by applicable law.
Nothing in this section limits non-waivable consumer rights that apply in your place of residence within the United States, Canada, Australia, or New Zealand.
Changes
We may modify these Terms. We will post updated Terms in the app and at usecirca.app/terms and update the "Last updated" date. Material changes may also be communicated in-app. Continued use after changes constitutes acceptance. If you do not agree, stop using Circa and delete your account.
Other
- These Terms are the entire agreement between you and Cyrene LLC regarding Circa and supersede any prior agreements on the same subject.
- We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law. You may not assign your rights without our prior written consent.
- If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be modified, and the rest of the Terms will remain in effect.
- Our failure to enforce a provision is not a waiver.
- Nothing in these Terms prevents us from complying with the law.
- Except as stated in Apple App Store Terms, these Terms do not create third-party beneficiary rights.
- You will comply with applicable U.S. and non-U.S. export-control and sanctions laws. You will not use Circa if you are on a restricted-parties list or located in a comprehensively sanctioned territory.
- Feedback you send us about Circa may be used without restriction or compensation.
- The English (United States) version of these Terms controls if a translation conflicts.
